Rules & Regulations
- The Cosmoprof North America Las Vegas 2025 CosmoTrends Competition (“CosmoTrends”) is only open to exhibitors attending Cosmoprof North America Las Vegas 2025 in Miami, Florida from January 21 - January 23, 2025 (the “Show”).
- CosmoTrends is sponsored by USA Beauty LLC dba Cosmoprof North America (“Organizer”). Employees (and their immediate families and households) of Organizer, BEAUTYSTREAMS, and its parent companies, subsidiaries, affiliates, dealers, and advertising and promotion agencies are not eligible to enter.
- BEAUTYSTREAMS, a beauty trends forecasting agency, will review and select, in consultation with Organizer, certain products reflecting specific new trends in the beauty industry. Based on all submitted Entry Forms, BEAUTYSTREAMS will establish categories that are trending in the beauty industry and score each product according to how well it sits in the relevant established category.
- BEAUTYSTREAMS will consider each short-listed entry against the category criteria and at its own discretion, based on its relevant experience and expertise within the beauty industry.
- Please submit only one entry for each applicant. Multiple entries will be voided. Entries must be submitted in English only.
- The entry period to submit an entry form for CosmoTrends (“Entry Form”) begins at or around 12:01 AM Pacific Standard Time (“PST”) on November 5, 2024 and ends December 6, 2024 at or around 11:59 PM PST. All Entry Forms must be submitted by December 6, 2024 to be eligible for CosmoTrends.
- Applicants will be asked to share information about their product, including a description, launch date, marketing strategy, and must provide a hi-resolution image of the product within the Entry Form.
- To ensure the highest possible score, the Entry Form for each award category should be completed in full, including only information that is relevant to the CosmoTrends’ category to enable the judging panel to assess merit.
- On or about December 20, 2024 Cosmoprof North America will contact applicants who have been short-listed via email and/or telephone. An Entry Form cannot be withdrawn from the judging process once the applicant has been short-listed.
- Each short-listed applicant will receive a seal from Cosmoprof North America to signify their product was selected as ‘trending’. Being short-listed to CosmoTrends earns applicants the opportunity to have their product featured at the Show. This prize package (“Prize”) has an approximate total value of $4000. Winners may not substitute, assign, or transfer the Prize, but Organizer reserves the right, at its sole discretion, to substitute a prize of comparable or greater value. Odds of being short-listed depend on total number of eligible Entry Forms submitted.
- Short-listed companies may be required to provide additional product information and copies of supporting documents upon the request of Organizer or BEAUTYSTREAMS to their Entry Forms.
- Once short-listed, applicants will be required to submit at least two (2) product samples requested by Organizer no later than January 07, 2025. At least two (2) product samples must be sent to Organizer, according to the instructions provided by Organizer. These product samples will be showcased at an onsite installation at the Show. Short-listed applicants are required to cover all shipping/courier costs and duties related to the product sample submission. Short-listed applicants acknowledge that they ship their product samples at their own risk and are fully responsible for any theft or damage that occurs during transport. Organizer disclaims any and all liability in case of deterioration, damage or alteration of the product samples during transport to the place of delivery indicated by Organizer or during the unpacking and installation of the product samples at the Show, including the loss of the samples during transport.
- All information submitted, including product samples, will not be returned.
- Entry to CosmoTrends does not grant an organization or individual rights to use the name, logo, or images of CosmoTrends, Cosmoprof North America, or any of its affiliates, without the express written approval of Organizer. Only short-listed applicants will be granted a limited, non-exclusive, revocable, royalty free permission to use a CosmoTrends logo in compliance with the guidelines stipulated by Organizer.
- Organizer reserves the right, at its sole discretion, to withdraw any applicants from the judging process at any time if their entries are deemed inappropriate for any reason (including false or inaccurate information declared in the Entry Form). Organizer also reserves the right, at its sole and unchallengeable discretion, to ban with immediate effect from CosmoTrends any applicant in case of:
- inaccurate completion of the Entry Form for whatever reason (including in case of provision of false or inaccurate information);
- ascertained or suspected infringement of third-party rights, including intellectual property rights and copyrights;
- disparaging behavior or corruption towards BEAUTYSTREAMS and/or Organizer’s personnel; or
- any dispute and/or claim pertaining to the products and/or to the contents presented by the applicant to CosmoTrends. In the event that the infringement and/or illicit behavior of the applicant should result in actions or claims by third parties also involving Organizer, the applicant in question shall indemnify and hold harmless Organizer and its affiliates from any and all direct or indirect damages, losses or expenses (including disbursements and legal fees) connected with or deriving from the aforementioned breaches or tort of the applicant.
- By submitting the designs, images and product samples to Organizer, each applicant agrees and declares they are authorized to and hereby grants Organizer, its affiliates, its licensees, and assignees, a royalty-free, non-exclusive, worldwide, perpetual license to exercise all rights in the designs, images and product samples and all material provided by the applicant to Organizer at any time (including, but not limited to, the right to use, to copy, edit and/or modify, publicly display, publicly perform, broadcast and republish in any/all media).
- Each applicant grants Organizer, BEAUTYSTREAMS, and their affiliates the right to use their name, likeness, biographical information and/or photograph, both online and in print, for the purposes of advertising, publicity, and promotional materials, without further consent required or additional compensation provided, except to the extent prohibited by law.
- Each applicant should note their product submission to CosmoTrends may be publicly disclosed. If deemed necessary or appropriate, the applicant should file a patent application before submission. Nevertheless, subject to institutional policy, each applicant shall be solely responsible for the pursuit of any form of intellectual property protection for their entry. Organizer is not liable for infringement or misuse of any design as a result of entry into CosmoTrends, or as a result of any subsequent promotion and publicity.
- Organizer is not responsible for proof of originality of entries, nor is liable for the protection of design copyright. Each applicant (i) retains sole copyright to their entry, (ii) is responsible for providing proof of originality of their entry, and (iii) is solely liable for their design(s), samples, and entry.
- In the event of any dispute, Organizer reserves the right to disqualify any entry and/or retract any Prize or award from the applicant. All decisions made by Organizer are final and binding in all aspects relating to CosmoTrends.
- Any applicant who, in the opinion of BEAUTYSTREAMS or Organizer, is perceived to have harassed or bribed any member of the judging panel or the CosmoTrends team, will have their entries disqualified. By entering CosmoTrends, each applicant warrants that: (a) all details provided with the Entry Form are true and accurate; (b) they have all necessary rights and licenses to grant the rights set out in these Rules & Regulations; (c) they are the copyright owner of the submitted photograph and/or images as its author (and any individual whose image is featured in the photograph has given consent for the use of his/her image); (d) they are the copyright owner and owner of all intellectual property rights in all logos and/or names of products submitted to CosmoTrends and, if selected, featured at the Show; (d) the exercise of the rights granted to Organizer in these Rules & Regulations will not infringe the rights of any third parties.
- Each applicant fully releases Organizer, BEAUTYSTREAMS, and its and their respective directors, officers, employees, agents, as well as the judges of CosmoTrends and all others associated with the development and execution of CosmoTrends (collectively, “Released Parties”) from any liability, loss, damage, or injury resulting from participating in CosmoTrends (including attending or exhibiting at the Show), or awarding, receipt, possession, use and/or misuse of any prize awarded herein. Released Parties are not responsible or liable for purchase or subsequent usage of any portion or component of the prize package. Released Parties assume no responsibility for any incorrect or inaccurate information, whether caused by website users, or by any of the equipment or programming associated with or used in CosmoTrends. Released Parties are not responsible for (i) any error, omission, interruption, deletion, defect, delay in operations or transmission, or communications-line failure, or (ii) theft of, destruction of, unauthorized access to, or alteration of Entry Forms. Released Parties are not responsible for any problems or technical malfunction of any computer online systems, servers, or providers, and computer equipment or software. Released Parties are not responsible for any failure of email or entry on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to any applicant or any person’s computer related to or resulting from participating in CosmoTrends or downloading or uploading materials to/from the websites. If the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes beyond the reasonably control of Organizer which corrupt or affect the administration, security, fairness, integrity, or proper conduct of CosmoTrends, Organizer reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify, or suspend CosmoTrends and award the prizes from among all Entry Forms received prior to the time of termination.
- Each applicant will fully indemnify Organizer, BEAUTYSTREAMS, and its and their affiliates against any loss, liability, damage, cost or expense whatsoever resulting from any CosmoTrends related activity, including participation in CosmoTrends, attending the Show, acceptance, use/misuse of any Prize, and any breach of these warranties or applicable law. Each applicant will fully indemnify the Released Parties for any loss, liability, damage, cost or expense in relation to any infringement of third-party intellectual property rights or violation of applicable law.
- The preshow CosmoTrends report will be released by January 20, 2025.
- The CosmoTrends post-show report will be published by February 28, 2025.
- BEAUTYSTREAMS' decisions are final and binding, and no discussions or correspondence will be accepted relating to any of its decisions.
- Organizer is not liable for any costs or liabilities incurred by applicants during the judging process.
- By entering, applicants agree that any personal information provided will be used/store in accordance with Organizer’s Privacy Policy. CosmoTrends, the Show, and related events, web pages, content and code are the property of Organizer or their licensors. Copying or unauthorized use of any copyrighted materials, trademarks, or any other intellectual property without the express written consent of owner is strictly prohibited. Void where prohibited or restricted.
